This website is operated by Baby Box Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Baby Box Ltd.
Please take few minutes to read the below information about the legal terms and conditions that apply to your use of www.babybox.co.nz (“the website”) and any services or products that you order from us. If you don't agree to these terms and conditions please do not use our website or order from us.
Acceptance
By using this website or purchasing from us, you agree to be bound by these terms and conditions. These terms and conditions therefore form a legally binding contract between you and Baby Box Ltd.
Age Restrictions
When you order products from us online, you are confirming that you are of the legal age to buy the products, and that the information you have provided us is true and accurate.
For example, in New Zealand, if you wish to buy something on credit you must be at least 18 years old.
Online Shopping
When placing information onto our website, we will take reasonable care in ensuring that all information about the product, including details, prices, product images and descriptions, are correct at the time.
While we have made every attempt to show appearances and colours of our products accurately, what you see will vary depending on your monitor and computer equipment. We therefore cannot guarantee that the product images are an exact representation of the actual products.
That said, if you're unhappy with your purchase, please review our Returns Policy. We may be able to sort things out for you.
Orders
We reserve the right to accept or reject an order for any reason due to unavailability of product, a genuine error in the price, image or the product description, or error in your order.
Please note that currently we only deliver orders to New Zealand unless by prior arrangement. This is because our regular courier companies are New Zealand based and we would need to investigate shipping costs in order to sell internationally.
We reserve the right to contact you for verification before we dispatch your order.
Product availability
We will try our best to ensure products ordered are available for delivery, and in most cases will notify you where a product is unavailable prior to you completing your order.
In some very rare cases this is not possible and we may need to reject an order you have placed for a product where we establish that it is unavailable for delivery. In such cases, we will refund in full all amounts you have in respect of such unavailable product.
We cannot provide "rainchecks" or "holds" for products ordered online, and reserve the right to limit the sale of products to reasonable or normal household quantities.
Variations of products and prices
We may vary the prices on this website at any time, and prices are subject to change until you have paid for the products in full.
Product availability and product prices may vary between our physical retail store and those found on this website. However, if this is the case, let us know, as we will often offer you the best price of the two.
Delivery
A standard flat rate fee per delivery and re-delivery will apply. The delivery fee is is non-refundable unless the goods fail to comply with the consumer guarantee provisions set out in the Consumer Guarantees Act.
You can review our Shipping Information page to find out more about delivery times and the courier companies we trust to ship your product to you.
However, it is important you note that we only deliver to physical addresses in New Zealand. We do not deliver to PO Boxes or International addresses, unless we have expressly arranged this with you prior to checkout.
We will make every attempt to deliver goods within the estimated time-frame however please beware that delays may occur due to unforeseen circumstances or factors that are beyond our control.
Returns
Please refer to our Returns Policy. We provide more than the legal minimum required by consumer legislation when it comes to accepting returns, because we recognise that sometimes our customers (or their babies) change their minds about a product.
Payment
All orders are calculated in New Zealand Dollars (NZD). You must pay for your products purchased on this website at the time of placing an order.
We accept Paypal and all major credit cards including MasterCard, American Express, Diners Club, and Visa. We also accept valid Baby Box gift cards, however you may need to email or call us to ensure that a gift card payment is processed correctly.
We will always act to protect the details of your payment and purchase however will not be responsible for any loss of damage that you may suffer if a third party acquires unauthorised access to date that you have provided to us when ordering from our website. The only exception to this is where Baby Box or its employees have been negligent with your payment information.
We use Shopify to assist our ecommerce platform. Shopify's servers will help secure your personal information with up-to-date firewalls and encryption techniques during the ordering and purchase process. A padlock or key will also be visible in the bottom of your web browser.
Damaged Products
We will met our obligations under the Consumer Guarantees Act. This means if the product was received damaged we will accept a return. Please refer to our Returns Policy.
We will not accept returns if you have damaged the product yourself by using the product in a manner that is inconsistent with the manufacturer's instructions or the intended use.
Gift Cards
Gift cards cannot be refunded or returned, unless required by law. Treat them like cash and keep them safe. We do not refund if you lose a gift card or have one stolen.
Our gift cards have a 2 year expiry and should be used within this time-frame.
Gift cards are readily accepted in the Baby Box physical shop. Please send us an email or call us if you would like to pay for an online purchase with a Gift Card as this will enable us to organise this for you.
Cancellations
You can cancel your online order provided that it has not been dispatched. Please contact us - our details are on our Contact Us page.
We will attempt to cancel your order without delay however occasionally it may not be possible to stop an order from being dispatched.
If your order has been dispatched please refer to our Returns Policy. You will need to pay for the return shipping, but otherwise we'll process this for you provided you are within our specified time-frame.
Password Security
You are responsible for maintaining your account and password confidentiality and all activities that take place under your password or account.
If you will be using a shared computer ensure that you logout of your account at the end of each session.
If you believe that there has been a security breach or misuse of your password or account, please let us know immediately. You can contact us using the details on our Contact Us page.
Baby Box Ltd will not be liable for any loss or damage that may occur as a result of your failure to comply with this clause.
Website Unavailablility
We will not accept responsibility if this site is unavailable to you as a result of computer downtime, malfunction or other factor/s beyond our control.
Competitions, Giveaways and Promotions
We may run competitions and promotions throughout the year, each with their own separate terms and conditions of entry. Please carefully read these terms and conditions of entry before entering or participating in a competition or promotion.

Our images are either created in house or supplied by our suppliers who have given us permission to use their images. Under no circumstance will we deliberately send you an electronic message without your consent.
Us publishing our contact details on our Contact Us page is also not to be taken as an invitation to subscribe us to any lists for electronic messages. However, you may contact us directly if you need to.
